Roethlisberger denies civil allegations of sexual assault
In a complaint that reads like the rape allegations made several years ago against NBA star Kobe Bryant, Harrah's employee Andrea McNulty alleges sexual assault against Steelers quarterback Ben Roethlisberger in a lawsuit filed last week in Washoe County, Nevada.
But lawyer David Cornwell strongly denied the allegations Monday night, in a statement released to PFT. "Ben has never sexually assaulted anyone; especially Andrea McNulty," Cornwell said.
In the civil suit, which Cornwell confirms was served on Roethlisberger over the weekend and a copy of which our own Gregg Rosenthal has obtained, McNulty alleges that Roethlisberger asked her to come to his hotel room to fix the television, and that he thereafter forced her to have sex with him.
Roethlisberger faces one civil count of assault, one civil count of sexual assault and battery, one civil count of false imprisonment, one civil count of false pretenses, one civil count of fraud, and one civil count of intentonal infliction of emtional distress.
McNulty also claims that the coworkers named in the complaint thereafter defamed her by making allegedly false and inflammatory statements, and by allegedly serving as aiders and abettors of Roethlisberger's alleged misconduct after the fact.
Cornwell, a finalist for the position of NFLPA Executive Director who has represented in the recent past Saints running back Reggie Bush and Browns receiver Donte' Stallworth, points to the fact that no criminal complaint has been filed, and that no criminal investigation has occurred.
"The timing of the lawsuit and the absence of a criminal complaint and a criminal investigation are the most compelling evidence of the absence of any criminal conduct," Cornwell said. "If an investigation is commenced, Ben will cooperate fully and Ben will be fully exonerated."
It's unknown at this point whether McNulty ever has attempted to file criminal charges as a result of the incident, which allegedly occurred in July 2008.
"Ben will not be baited into a public discussion about his personal life, but we will defend
him vigorously," Cornwell said. "The limited value that Ms. McNulty derived from public disclosure of these viciously false allegations is the only value she will ever receive from Ben in this case."
Regardless of how this one turns out, it has the potential to serve as a significant distraction for Roethlisberger as the 2009 season approaches, especially if the lawsuit triggers a criminal probe.

That's not slander. It would be making a false statement, which in some states is equal to perjury.Kumicho wrote:If she's making this shit up, I hope she does 2 years hard time for slander...

Ah, I see what you are saying. When a woman cries rape it does in fact deface a man's name. Even if innocent a man will always be looked upon as a rapist. Is that where you are going with that? I'd agree.
But in legal terms...slander is a civil lawsuit where perjury is a federal crime. I'd rather see the bitch serve some time in jail over some civil lawsuit for money she probably doesn't even have.

I am talking slander in the sense of criminal defamation...I guess it would vary from state to state, even though it would ultimately probably involve a law suit...Considering this chick probably doesn't have nearly the amount of money that this could cost Ben, I'm not sure what would happen...But, I know if you owe back child support, they put your ass in jail if you can't pay...So, if Ben sued this chick for slander or whatever, she'd probably suffer a similar fate...

You know what, I agree completely. I would really like to see these women who cry rape get punished SEVERELY for it if it is found to be untrue.
There's probably nothing more heinous in the world than rape, so to see people continually charge these athletes of it in the hopes of making a quick buck is not only despicable, but shows how ridiculous our legal system can be at times.
"The man has a lot of money...I'm a woman...hmmm, I should say he raped me to get some of that money" - if that's the thought process that goes on in these woman's heads....most likely its coupled with "he'll probably just settle it out of court so he doesn't have to deal with it....and hey, I'll get some money!"
I mean, I don't know if its true or false..but I know even in fucking high school if you were a star player...you were getting tang thrown your way. So you're gonna tell me this superbowl winning quarterback doesn't have the oppurtunity to score some free and easy pussy whenever he wants, in fact...he's got such a hard time getting it, that he has to force himself on this (probably ugly) chick who works at a hotel?
Give me a fuckin' break.
Now if he did do it, disregard everything I've said :) lol
The fact that she's not pressing criminal charges seems to me to point even more towards the fact that she's just trying to get money out of the deal....
As far as being a distraction....if the man didn't do it...I don't think it will be much of one. He can shrug it off knowing its just another Billie Jean.....and keep making football plays.

No, not really. Can't enforce lawsuit settlements by arresting people. OJ Simpson never did pay that money from the civil lawsuit he lost for those murders.Kumicho wrote:I am talking slander in the sense of criminal defamation...I guess it would vary from state to state, even though it would ultimately probably involve a law suit...Considering this chick probably doesn't have nearly the amount of money that this could cost Ben, I'm not sure what would happen...But, I know if you owe back child support, they put your ass in jail if you can't pay...So, if Ben sued this chick for slander or whatever, she'd probably suffer a similar fate...
Child support is an entirely different beast. It's a federal law and that's why it can be enforced by jail time.
The sick part is that if a man pays child support and has visitation rights and the mother doesn't let the father see the child? Nothing the Police can do to enforce anything...even if a court has decided the visitation. Can take her to court again but that takes up lawyer fees, court fees, etc.
Big Ben can sue her but it would be a moot point. It would be up to the DA on whether they wanted to pursue perjury charges against her. Most likely this will all be settled out of court for money...just like what Kobe did.

Re: Roethlisberger denies civil allegations of sexual assault
Here's an update...
http://sports.espn.go.com/nfl/news/story?id=4385103
Apparently one of Andrea McNulty's co-workers has said that she bragged about having sex with the Roethlisberger.
This is looking more and more like a typical woman scorned.
